T&C - General Terms and Conditions of Use and Sale – NOWA


1. Purpose

These General Terms and Conditions of Use and Sale (GTC) govern access to and use of the website nowa.care, its associated mobile applications, and the digital services offered by NOWA.CARE, a single-shareholder simplified joint stock company (SASU) registered with the RCS of Évry under number 990 265 647, with its registered office located at 7 avenue de Laponie, 91940 Les Ulis, France. President: Figonia Holding. Contact: support@nowa.care.


2. Eligibility conditions and account creation

  • The Services are reserved for individuals who are of legal age (18 years or older).
  • The User agrees to provide accurate information, to maintain the confidentiality of their credentials, and to report any unauthorized use.
  • The account is personal and non-transferable.
  • The User may request the deletion of their account at any time via support@nowa.care. NOWA will then delete the personally identifiable data; anonymized data may be retained for statistical or research purposes.

3. Nature of services

NOWA is a digital fertility support platform that offers:

  • personalized fertility assessments based on entered and/or imported data;
  • recommendations generated by artificial intelligence with human oversight;
  • educational content and coaching programs;
  • access to a community and partner experts (doctors, coaches, psychologists, nutritionists).

NOWA is not a medical provider: its services are for informational and preventative purposes only. They do not replace a medical diagnosis, treatment, or follow-up in any way.


4. Personal Data Protection

NOWA processes personal data in accordance with its Privacy Policy. The processing complies with the GDPR and the French Data Protection Act. Health data is hosted on HDS-certified (OVHcloud) servers in France.

NOWA uses AI and OCR technologies (notably via OpenAI, under HIPAA-compliant BAA); data is anonymized before being sent to external systems. The User agrees that their anonymized data may be used to improve the service, for studies or research projects. Any request for access, rectification, or deletion can be sent to support@nowa.care.


5. Subscriptions, payments, and right of withdrawal

a. Prices and plans

NOWA's standard offer includes an Essential monthly subscription at €39 including VAT per month, giving access to:

  • all the application's features;
  • the Evolving Fertility Plan;
  • personalized coaching and the community.

NOWA reserves the right to offer temporary promotional offers, including reduced prices (for example: launch offer at €19 including VAT/month), free trials, or coupons.

b. Payment

Payments are made via secure providers (Stripe, Apple, Google). NOWA does not store any bank details. Prices are displayed in euros, including all taxes.

c. Renewal and cancellation

Subscriptions are automatically renewed each month unless canceled before the due date via the user area or the Store settings. The User can cancel at any time; cancellation takes effect at the end of the current period.

d. Right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to digital content provided immediately after payment, with the consumer's prior agreement and express waiver.

e. Free trial

Some offers may include a free trial period. At the end of this period, the subscription becomes paid unless canceled before the due date.


6. Use of services

  • Do not misuse the Services for illegal or unethical purposes.
  • Do not copy, redistribute, or exploit content without permission.
  • Do not post abusive, defamatory, or unlawful content.

NOWA reserves the right to suspend or delete an account if these conditions are not respected.


7. Communities and support

NOWA offers community spaces (WhatsApp, public or private channel) to encourage mutual support. Groups reserved for subscribers are accessible only for the duration of the active subscription. Registration is voluntary; exchanges remain confidential between members.


8. Intellectual property

All content (text, logos, code, graphics, reports, trademarks, AI, and recommendations) is the exclusive property of NOWA.CARE or its partners. Any unauthorized reproduction, distribution, or extraction is prohibited.


9. Partners and third-party services

NOWA collaborates with selected clinics, laboratories, coaches, and financial partners. NOWA cannot be held responsible for the services provided by these third parties; any complaints regarding these services should be addressed directly to them.


10. User content and feedback

Users may be invited to share their experiences, submit content, or provide feedback. By submitting content, the user grants NOWA a free, non-exclusive, and unlimited right to use the content to improve the service, subject to respecting anonymity. NOWA may remove any content deemed inappropriate.


11. Liability and force majeure

NOWA strives to ensure the availability of its services but cannot guarantee uninterrupted operation. The services are provided "as is."

NOWA declines all responsibility in the event of:

  • indirect damages or data loss;
  • erroneous interpretation of a report or recommendation;
  • temporary unavailability;
  • events of force majeure (network failure, disaster, cyberattack, etc.).

12. Applicable law and competent jurisdiction

These Terms of Service are governed by French law. Any dispute will be submitted to the competent courts within the jurisdiction of the Paris Court of Appeal.


13. Modifications to the Terms of Service

NOWA may update these Terms of Service at any time. Significant changes will be notified via the application or by email. Continued use of the Service constitutes acceptance of the new conditions.
