Terms and Conditions of Use and Sale (TCUS) – NOWA

By accessing NOWA's services, the User acknowledges that they have read these General Terms and Conditions of Use and Sale and accept them without reservation.

1. Purpose

These Terms of Use govern access to and use of the nowa.care website, associated mobile applications, and digital services offered by NOWA.CARE, a simplified single-member corporation (SASU) registered in the Évry Trade and Companies Register under number 990 265 647, whose registered office is located at 7 avenue de Laponie, 91940 Les Ulis, France.

2. Definitions

• NOWA: the company NOWA.CARE and the platform nowa.care.
• User: any individual using the Services.
• Services: all services offered by NOWA, as described in Article 3.
• Partners: physicians, examination centers, clinics located in the European Union and other third-party providers involved in the Services.
• Content: data, information, documents, and responses transmitted by the User.

3. Nature of services

NOWA is a digital fertility support platform with an informative, organizational, and preventive focus. NOWA is a digital fertility support platform with an informative, organizational, and preventive focus.

3.1 Initial offer (maintained)

NOWA offers, in particular:

• personalized fertility assessments based on entered and/or imported data; imported;
• recommendations generated by artificial intelligence with human supervision;
• educational content and coaching programs;
• access to a community and expert partners.

3.2 Patient-oriented services

a) Fertility assessment – prescription (€30 including tax)

The User compiles their file (questionnaires and documents).

If the medical criteria are met, a partner physician can issue a prescription, usually within 24 hours as a guideline.

NOWA:

• acts as a coordinating intermediary;
• directs the User to partner examination centers;
• does not guarantee that the prescription will be issued, as this is solely at the discretion of the physician.

Price: €30 including tax (fixed rate).

b) Second medical opinion – written opinion

The User submits their documents and completes the questionnaires.

A partner medical specialist provides a single written medical opinion based on the information provided.

• The notice does not include any subsequent questions and answers.
• This is a one-time notice, not a recurring one.

A teleconsultation may be offered upon request and will be billed separately, according to the conditions specified at the time of ordering.

c) MAP abroad – European Union

NOWA supports Users in their ART projects at clinics located exclusively in the European Union (particularly Spain and Portugal).

Support includes:

• assistance in selecting partner clinics;
• preparation and structuring of medical records;
• the transmission of the file only after explicit validation by the User;
• analysis and evaluation of estimates;
• organizational support for the project.

NOWA can also help the User draft a request for reimbursement from social security , with no guarantee of acceptance.

Price: support package of €490 including tax, paid by the User.

3.3 Absence of medical services provided by NOWA

NOWA is not a healthcare facility and does not perform any medical procedures.

Prescriptions, medical opinions, teleconsultations, examinations, treatments, and protocols are the exclusive responsibility of partner healthcare professionals, who are solely responsible for their decisions and services.

4. Eligibility requirements and account creation

The Services are reserved for adults (aged 18 and over).

The User agrees to provide accurate information and to keep their login details confidential.

The account is personal and non-transferable.

5. Deadlines and no guarantee of results

The deadlines provided are indicative.

In particular, NOWA does not guarantee:

• the issuance of an order;
• access to a clinic or assisted reproductive technology (ART) protocol;
• obtaining a refund;
• a medical or clinical result.

6. Personal data and medical records

NOWA processes personal data in accordance with its Privacy Policy (nowa.care/privacy).

Health data is hosted on HDS-certified servers (OVHcloud, France).

NOWA may use AI and OCR technologies (including via OpenAI, under HIPAA-compliant BAA).

The User guarantees that they are authorized to transmit the documents provided.

7. Rates and payments

7.1 Subscription

NOWA offers a monthly Essential subscription for €39/month (including tax), giving access to the app's features, the Progressive Fertility Plan, coaching, and the community.

7.2 One-time offers

• Fertility assessment: €30 including tax
• Second medical opinion (written): price indicated when ordering
• Second opinion teleconsultation: billed separately
• Assisted reproductive technology abroad (EU): flat rate of €490 including tax

Payments are made via secure providers (Stripe, Apple, Google). NOWA does not store any banking information.

8. Right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply:

• digital content provided immediately after payment;
• services whose performance has begun with the express agreement of the User.

The User acknowledges that the Assessment, Second Opinion, and EU MAP offers may begin immediately after ordering (file analysis, transmission, coordination).

9. Partners

NOWA acts as a coordinator and liaison.

The partners remain solely responsible:

• medical procedures;
• quality of care;
• the applicable deadlines, rates, and conditions.

Any complaints regarding medical treatment should be addressed directly to the relevant partner.

10. Liability

The Services are provided "as is."

NOWA shall not be held liable for:

• decisions made by the User based on the content;
• acts or omissions of partners;
• a medical or clinical failure;
• indirect damages or loss of opportunity.

11. Applicable law

These Terms of Use are governed by French law.

Any dispute shall fall within the jurisdiction of the courts within the jurisdiction of the Court of Appeal of Paris.

Appendix 1 – NOWA Community Charter

The community spaces offered by NOWA aim to promote exchange, support, and the sharing of experiences.

By participating, the User agrees to:

• respect other members and their backgrounds;
• do not disseminate offensive, discriminatory, or defamatory comments;
• not provide personalized medical advice;
• respect the confidentiality of exchanges.

NOWA reserves the right to withdraw access to the community from any User who does not comply with these rules, without prior notice or compensation.
